We were asked by an engineering firm to review the economic damages claimed by a wind farm operator that suffered a loss caused by damage to a transformer caused by the work of the engineering company.
The damage resulted in the wind farm not being able to operate for over a month and a resultant loss of revenue from the generation and sale of electricity.
Our role was to review the generation profile of the 22 turbines in the wind farm and calculate a loss of income and associated saved operating costs. We were subsequently also involved with the adjudication process at the International Dispute Resolution Centre in London. This involved presenting our analysis to the wind farm operator and their lawyers, as well as the adjudicator. Our involvement assisted in the financial loss being settled between the two parties and the defendant paying less than what was originally being claimed by the wind farm operator.
